How can I use these photos?

Please read through these licenses to understand exactly what you are and are not allowed to do with the digital downloads you purchase from BuySurfPix.com. Photographers may select which licenses they provide their photos under, and you may decide which license to purchase if there are multiple licenses offered for the photo. Licensing information for each photo is displayed on the checkout page prior to purchasing your photos. If you have any questions or concerns, please get in touch at support@buysurfpix.com.

Personal Use

The Photographer ("Content Provider") grants the buyer a non-exclusive perpetual personal-use license to download and copy the accompanying image(s) or video(s) (collectively, "Media,") subject to the following restrictions:

• This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites, social networking websites, and computers, or for making prints or video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration.
• The Media may not be used in advertising.
• The Media may not be resold, relicensed, or sub-licensed.
• Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with the Content Provider.
• There are no warranties, express or implied. The Media are provided 'as is.'
• Neither the Content Provider nor BuySurfPix.com will be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of the Media.

Can I upload these photos to Facebook, Twitter, Instagram, etc?

Yes and No. With the Personal Use license, you are allowed to upload and share these photos on your personal social networking accounts. Posting these images to a company's social networking account (eg. a company's Facebook Page), whether officially set up as a business account or as a personal account, is not permitted.

Commercial Use

Commericial Use licenses are not currently available through BuySurfPix.com. If you are interested in an image for commerical use, please contact us at support@buysurfpix.com with details regarding the photo(s) you are interested in. We will contact the photographer and put them in touch with you to discuss any commericial use of the images.

For Photographers

When uploading photos, the contributor/photographer shall select the license option offered for the images they upload. If changing the licensing options in the futurefor the photo, any customers that have previously purchased the photo shall retain the license granted to them at the time of purchase.

The photographer ("Contributor") retains ownership and copyright of uploaded images and these images shall not be considered assets of BuySurfPix.com in the event of a voluntary or involuntary bankruptcy. While BuySurfPix.com takes commercially reasonable steps to ensure that the rights of its Contributors are not violated by customers or other parties, BuySurfPix.com has no authority or obligation to pursue legal action against any alleged infringer of any rights in and to any images posted to BuySurfPix.com.

Subject to this Agreement, the Contributor grants BuySurfPix.com a non-exclusive license to market, sell and distribute the Contributor's Uploaded Images throughout the world and all rights to grant sublicenses to Uploaded Images, and to reproduce, distribute, publish, transmit, broadcast, display, exhibit, adapt, crop, modify, recast or enhance, any Uploaded Image, alone or in combination with any other material, in any media or embodiment, now known or later developed, for any lawful purpose, including the right to distribute and sell consumer products.

During the term of this Agreement, the Contributor grants BuySurfPix.com the right, but not the obligation, to use the Contributor's name, trademarks and trade names and the right to reproduce, display, transmit, broadcast and adapt any Uploaded Image to promote, advertise and market BuySurfPix.com; and the photographer agrees that no compensation or further consent is due for such use. Marketing may include the use of Uploaded Images on social networking sites. Additionally, the rights granted herein will include the right to use Uploaded Images as necessary to test or evaluate any technologies, systems, or processes that BuySurfPix.com may use to fulfill its obligations and exercise any rights granted under this Agreement.

The Contributor represents and warrants to BuySurfPix.com that:

• The Contributor, if an individual, is at least 18 years of age, and has full corporate power and authority to enter into this Agreement;
• The Contributor is the sole owner and copyright holder in the Uploaded Images, and/or has the right to grant BuySurfPix.com the licenses in the Uploaded Images;
• The Uploaded Images are original and do not infringe on, violate or misappropriate any third party copyright, trademark, rights of privacy, publicity, moral rights, defames any third party, are pornographic or obscene, or violate any other third party right;
• Any caption information, keywords, metadata or other information submitted with the Uploaded Images is relevant, accurate and complete, and does not contain false or misleading information;
• A valid release, either model/and or property has been obtained where necessary and appropriate for each Uploaded Image and Company may use such Selected Images without obtaining any additional consents or permissions or the payment of additional fees to third parties; and
• The Uploaded Images contains no viruses, spyware, Trojan horses, time bombs, or other similar harmful or deleterious programming routines or code.

BUYSURFPIX.COM SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE TO SELECTED IMAGES OR MATERIAL SUBMITTED TO BUYSURFPIX.COM AND CONTRIBUTOR SHOULD MAINTAIN ITS OWN BACKUP FILES FOR ANY UPLOADED IMAGES SUBMITTED TO BUYSURFPIX.COM. BUYSURFPIX.COM'S MAXIMUM AGGREGATE LIABILITY (WHETHER IN TORT, NEGLIGENCE, CONTRACT, OR OTHERWISE) FOR ANY CLAIM ARISING UNDER THIS AGREEMENT, THE USE OF SELECTED IMAGES PROVIDED TO COMPANY OR THE USE OF THE WEBSITE EXCEED THE FEES COLLECTED BY BUYSURFPIX.COM FOR THE SELECTED IMAGES THAT IS THE SUBJECT MATTER OF THE CLAIM. THE CONTRIBUTOR ACKNOWLEDGES THAT BUYSURFPIX.COM WILL NOT BE RESPONSIBLE FOR THE MISUSE OF THE SELECTED IMAGES BY THIRD PARTIES. NEITHER PARTY SHALL, UNDER ANY CIRCUMSTANCES, BE LIABLE TO THE OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, EVEN IF SUCH PARTY HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING.
